The conditions of this environmental authority are in force until surrender of the authority is accepted pursuant to the Environmental Protection Act 1994. The conditions apply unless an amendment is approved pursuant to the Environmental Protection Act 1994.

The environmental authority holder is to give the administering authority a financial assurance in the amount and form and at a time required by the administering authority.

The environmental authority holder must comply with each of the Standard Environmental Conditions contained in the Code of Environmental Compliance for Exploration and Mineral Development Projects, except Condition 13, which is replaced by the conditions in this environmental authority.

If there is any inconsistency between a standard environmental condition referred to in A3 and an additional condition in this environmental authority, the additional condition prevails to the extent of any inconsistency. Land

The environmental authority holder is authorised to carry out mining activities on EPC1033, within 500m of any Endangered Regional Ecosystem.

In carrying out mining activities within 500m of any Endangered Regional Ecosystem, the environmental authority holder must comply with each of the Standard Environmental Conditions contained in the Code of Environmental Compliance for Exploration and Mineral Development Projects.

In carrying out mining activities on EPC1033 all reasonable and practicable measures must be taken to prevent or minimise the likelihood of environmental harm being caused to Endangered Regional Ecosystems 11.4.3, 11.4.8, 11.4.9 identified in Attachment 1. _____________________________________________________________________________________________________________ Permit

Mining activities undertaken within Endangered Regional Ecosystems must be consistent with the "Environmental Management Plan for EPC1033" and with the schedule of works proposed in "Figure 3: EPC1033 Regional Ecosystems, Buffers & Drill Sites".

When carrying out mining activities within 500m of any Endangered Regional Ecosystem the holder of the environmental authority must do so in accordance with conditions B6 to B11.

The environmental authority holder is permitted to drill a maximum of 19 exploratory holes within 500m of any Endangered Regional Ecosystem.

The environmental authority holder is permitted to drill 128 exploratory holes on EPC1033.

Drill Sites (a) Locate drill sites outside of Endangered Regional Ecosystems, where practicable; and (b) Operational area is to be no greater than 500 square metres; (c) Sump size is to be no greater than 10 square metres; (d) Topsoil stripping must be limited to sump area; (e) All clearing of mature trees must be prevented or minimised

Tracks (a) Locate tracks outside of Endangered Regional Ecosystems, where practicable; and (b) Spacing's between tracks must not be less than 250m; and (c) Existing access and fence line tracks must be used where possible and any tracks constructed must link natural clearings; and (d) Track construction involving blade clearing or established ground cover vegetation and or clearing of mature trees is prevented or minimized; and (e) Line of site clearing must be avoided; and (f) Construction of new crossings over watercourses must be avoided and is only permitted when no reasonable alternative is available; and (g) All tracks must be constructed and maintained with adequate drainage to avoid accelerated erosion; and (h) Access tracks must be less than 5m in width.

Other Land Disturbance (a) Activities within Endangered Regional Ecosystems must not include costeaning or bulk sampling; and (b) All equipment such as earthmoving and drilling equipment must be used in a manner which prevents the spread of weeds, minimises unnecessary disturbance of topsoil and ground cover vegetation; and (c) Campsites must not be established; and _____________________________________________________________________________________________________________ Permit (d) All waste must be removed and disposed offsite.

Rehabilitation and Reporting (a) Rehabilitation of areas disturbed within Endangered Regional Ecosystems must be completed as soon as practicable but no longer than 3 months after completion of the disturbance activity; and (b) The environmental authority holder must revegetate disturbed areas of Endangered Regional Ecosystem with native plant species endemic to the area that will promote the same vegetation type and density of cover to that of the surrounding undisturbed areas of Endangered Regional Ecosystem; and (c) An annual report must be prepared each year and submitted with each annual return. The report must include details of exploration activities undertaken and details of progressive rehabilitation works completed to demonstrate compliance with B9 (b). _____________________________________________________________________________________________________________ Permit 4.0 DEFINITIONS Administrating authority - Means - (a) for a matter, the administration and enforcement of which has been devolved to a local government under section 514 of the Environmental Protection Act 1994; or (b) for all other matters - the Chief Executive of the Environmental Protection Agency; or (c) another State Government Department, Authority, Storage Operator, Board or Trust, who's role is to administer provisions under other enacted legislation (e.g. Department of Natural Resources who licence referable dams under the Water Act 2000). Annual exceedence probability (AEP) - For a given rainfall event the AEP is the probability that the event will be exceeded within a one year period. The AEP is usually expressed as a one in `n' (years) or a percentage. Approved form - Means a form approved by the administrating authority. Archaeological site - A site that has physical evidence of the past, which has the potential to increase our knowledge of earlier human occupation, activities and events. Artesian drill hole - An exploration drill hole from which water freely flows at a rate of greater than 500 L/hour for at least 7 days after being drilled. Banks - The feature which confines major flows within a watercourse. They are steeper than a terrace and are generally of a slope greater than 1:1 on outer bends. Refer to Figure 1 - Cross Section through a Watercourse. Bund - (a) An earth mound or similar structure (e.g. a concrete block wall), whether impervious or not, constructed to contain spilled material (e.g. petrol, diesel, oil etc); or (b) a structure to prevent or reduce soil erosion. Campsite - The area encompassing any dwelling, amenities (e.g. toilet block, power generator), sewage or general waste disposal facility and includes the office area and vehicle parking areas associated with a temporary or permanent mining camp. Contaminant - The Environmental Protection Act 1994 defines, under Section11, a contaminant as: (a) a gas, liquid or solid; or (b) an odour; or (c) an organism (whether alive or dead), including a virus; or (d) energy, including noise, heat, radioactivity and electromagnetic radiation; or (e) a combination of contaminants.
